Administrative Procedures for the Registration and Filing of Provisional Activities of the Representative Offices of Overseas Non-Governmental Organizations (NGO) Engaged in Tourism Research, Exchanges and Cooperation (Trial)


These procedures are established for the work of the administrative registration and filing of the provisional activities of the representative offices of overseas non-government organizations (NGO) engaged in tourism research, exchanges and cooperation, in accordance with the related regulations contained in the "Law of the Administration of the Activities of Overseas Non-Governmental Organizations in the People´s Republic of China".

I. Responsibilities and Scope
Overseas non-governmental organizations, or NGOs, refer to the non-profit organizations and non-governmental social organizations created outside China like foundations, social groups and think tanks. According to the "List of the Areas and Projects of Activities of Overseas Non-Governmental Organizations in China & List of Competent Authorities (2017)" released by the Non-Governmental Organizations Administration Office under Shanghai Municipal Public Security Bureau, Shanghai Municipal Administration of Culture and Tourism can exercise supervision and administration over the NGOs whose areas of activities involve tourism research, exchanges and cooperation, and is responsible for examining and approving the creation of the representative offices of NGOs in Shanghai and changes to the registration details, and for guiding and supervising the activities of such representative offices.

II. Registration of Representative Offices of NGOs Engaged in Tourism Research, Exchanges and Cooperation
(I) Establishment registration
1. Application conditions
An NGO whose areas of activities involve tourism research, exchanges and cooperation can apply for the establishment of a representative office in Shanghai to Shanghai Municipal Administration of Culture and Tourism, provided that the NGO
(1) has been legally established abroad;
(2) is able to assume civil liabilities independently;
(3) is a non-profit, non-governmental social organization conducive to the development of public welfare undertakings;
(4) has been in existence for more than two years and has conducted substantive activities abroad; (5) meets the other conditions as prescribed by laws and administrative regulations.
2. Application procedures
(1) The overseas NGO makes the application to Shanghai Municipal Administration of Culture and Tourism and provides the required materials;
(2) Shanghai Municipal Administration of Culture and Tourism reviews the submitted materials;
(3) Shanghai Municipal Administration of Culture and Tourism seeks comments from Shanghai Municipal Public Security Bureau with respect to the NOG which meets the conditions and issues a written document of approval to the NGO whose application has been approved.
3. Application materials
(1) "Overseas NGO Representative Office Registration Form/Provisional Activities Filing Registration Form, Shanghai Municipal Administration of Culture and Tourism (Form 1);
(2) documents and materials that can prove that the NGO has been legally established overseas;
(3) "Articles of Association" of the overseas NGO;
(4) materials that can prove that the NGO has been in existence for more than two years and has conducted substantive activities abroad.
(II) Changes to registration
In the case of changes to the name of the representative office, chief representative, residence, scope of activities, geographical areas of activities and competent authorities, an application must be made to Shanghai Municipal Administration of Culture and Tourism.
1. The following materials must be provided:
(1) An application form for the changes to the registration (Form II);
(2) Documents of proof of such changes
2. Shanghai Municipal Administration of Culture and Tourism reviews the application.
3. Shanghai Municipal Administration of Culture and Tourism issues a written document of approval to the NGO which meets the conditions.

III. Filing of the Temporary Activities of NOGs Engaged in Tourism Research, Exchanges and Cooperation
1. Application conditions
If an overseas NGO has not established a representative office in Shanghai but intends to carry out temporary activities related to tourism research, exchanges and cooperation, such an NGO shall first have its activities filed with Shanghai Municipal Administration of Culture and Tourism, provided that the NGO
(1) has been legally established abroad;
(2) will cooperate with the state organs, people´s organizations, institutions and social organizations of China (hereinafter referred to as "Chinese Cooperative Units").
2. Application procedures
(1) The overseas NGO makes the application to Shanghai Municipal Administration of Culture and Tourism and provides the required materials;
(2) Shanghai Municipal Administration of Culture and Tourism reviews the submitted materials;
(3) Shanghai Municipal Administration of Culture and Tourism seeks comments from Shanghai Municipal Public Security Bureau with respect to the NOG which meets the conditions and issues a written document of approval to the NGO whose application has been approved.
3. Application materials
(1) "Overseas NGO Representative Office Registration Form/Provisional Activities Filing Registration Form, Shanghai Municipal Administration of Culture and Tourism (Table 1);
(2) documents and materials that can prove that the NGO has been legally established overseas; (3) "Articles of Association" of the overseas NGO;
(4) materials that can prove that has been in existence for more than two years and has substantive activities abroad.
(5) The name, purpose, geographical area and duration of the specific provisional activity.

IV. Supervision over and Guidance for the Activities in Normal Times
Shanghai Municipal Administration of Culture and Tourism is responsible for offering guidance to, and exercising the supervision over, the representative offices of the overseas NGOs engaged in tourism research, exchanges and cooperation, and for offering services in various fields to facilitate their work, creating a communication mechanism, and learning the activities of the previous year and the plan of the following year.
